If we had just used Fresh Air for example, then it would be up for grabs - you can't get a patent on 'words' - it has to be something that's not an actual word. Hope this helps. Josie G Freshaire Business Services Copywriting - Sheffield - South Yorkshire Josie, it seems you're mixing up your 'IP crayons' a little bit I believe you are referring to trademarks, not copyright or patents. * Patents are for how widgets work * Designs are for how widgets look * Trademarks are for how widgets are branded ... and Copyright is for the rest Assuming you actually applied for trademark protection, you might have got 'Fresh Hair' registered, depending on what the brand is for and of course whether anyone had registered it first. That said, "something that's not an actual word" (a 'fanciful' word mark, is how we call it) does help the registration process a lot, because it (inherently) can't be descriptive of the goods/services to which it relates. Note that domain names, company names as registered at Companies House and trademarks are entirely distinct: buying a domain name and/or registering a company name at Companies House does not entitle you to the corresponding trademark (it's a first come-first served system).
