Arrested for no reason

I reckon there's more to this than the OP is letting on. Nobody gets arrested for no reason, the police have to have reasonable grounds to suspect a crime has been committed before they arrest anyone!
you need to look at the real world mate they even shoot innocent people

The Police have the power of the Government and the realm backing them up. They will and can do what they want and are literally a Law unto themselves. If they slip up they will close ranks and lie if needs must. Even wide open cases like the London copper who wacked the girl protester said he thought her milk shake was a weapon so he defended himself by mashing all eight stones of her. He came out of Court to a waiting Police vehicle and sneered straight into the cameras, a real nasty cockroach.

ANY decent Law abiding Citizen can become an unlikely victim as easy as that and just try and fairly get yourself out of it, nigh on impossible.

That is why you should always have a solicitor.

 

I think you will still be able to get a copy, just contact them and ask.

 

He should have been offered to choose one for him to keep after the interview had ceased, you even have to sign for them, so the coppers are certainly in the wrong there, just that alone would be enough to throw most cases out of court if it got that far.

The Public Order Act 1986, Section 5 states:

 

(1) A person is guilty of an offence if he:

 

(a) uses threatening, abusive or insulting words or behaviour, or disorderly behaviour, or

(b) displays any writing, sign or other visible representation which is threatening, abusive or insulting,

 

within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby.

 

This offence has the following statutory defences:

 

(1) The defendant had no reason to believe that there was any person within hearing or sight who was likely to be alarmed or distressed by his action.

(2) The defendant was in a dwelling and had no reason to believe that his behaviour would be seen or heard by any person outside any dwelling.

(3) The conduct was reasonable.

 

This offence is what the OP sounds as though he was arrested for. If he was arrested within 72 hours of the alleged crime being reported, and the investigation was completed in that time, then if he has denied the offence, a custody sergeant has the power to release the OP for there being insufficient evidence. There probably would not be a crime report created, as SYP would not like an undetected crime on their records so this may not affect any future crb checks, however, there will now be a record on the PNC of the OPs details and his DNA will be stored.

Everyone makes mistakes it is just that when police or doctors make them it generally has a massive affect on someone. I remember the old West Mids Crime Squad had a reputation for busting doors down on the wrong street like XXXXplace not XXXXroad. Final nail in their coffin is when they raided a flat and shot real bullets into the bed only to find there was a two year old under the bed. I suppose it's all about keeping it in proportion. Imagine if you had been a Brazillian Electrician? We could be discussing this with your relatives.
