Anyone sat in a car on the drivers side behind the steering wheel is in charge of a vehicle. Is it illegal to use a mobile phone while stationary ? Taking the risk of 3 points and a fine for the inconvenience of plugging in the headphones and having speed dial set up even if they don't have the full hands free kit.
