Would you politely remind a driver using a mobile is illegal?

Anyone sat in a car on the drivers side behind the steering wheel is in charge of a vehicle.

Is it illegal to use a mobile phone while stationary ?

I see people on mobiles every day on my seven mile commute. Taking the risk of 3 points and a fine for the inconvenience of plugging in the headphones and having speed dial set up even if they don't have the full hands free kit.

 

I find a good honk makes them drop the phone.

Pointing out to someone that their illegal, reckless behaviour is placing other people at risk is not "winding them up".

How is it reckless to use a phone whilst not moving?
