Without any further information it's a pretty pointless OP.

Ricgem2002, when starting new threads relating to news stories, please always provide a link to said story. That way, members can make their own opinions on the matter.

 

Not sure if this is the same story, but it seems likely.

If he can walk 400 metres, he does not qualify for DLA. Neither does anyone else who can walk that far.

 

My wife was refused DLA on her first application because the tribunal believed she could walk 200 metres. (She couldn't, but they refused to listen to our appeal.)

 

If he remains unfit for work, he will continue to draw whatever the new name for Incapacity Benefit is, which I've forgotten again.
