kebab69man Posted August 24, 2010 Share Posted August 24, 2010 my son has a council flat was in receipt of benefits and was sentenced to ten months inside yesterday is it possible to keep his flat on til he's released which will be about 4 months give or take a few days. A tenant does not have to quit a property just because they are away from it, as long as the landlord knows, and the rent is been paid. Also, whoever is representing the tenent in his abscence has written permission. With regards to benefits, offenders can only claim for up to 52 weeks whilst they are on remand. on passing of sentence they cannot claim housing benefit or council tax benefit. So, if your son wishes to keep his flat, full rent must be paid after the sentencing date. sallyanne4 Posted September 24, 2010 Author Share Posted September 24, 2010 thanks for all replies have been to benefits and they will pay benefit up to 13 weeks even tho his sentence is longer probation have sent a letter to confirm his release on tag.
