Refusing to take a breath test is also an arrestable offence. The principle being to stop further bigger offences which may not happen if they are a good driver. It is assumed that the influence will cause a crash even if it may not. Quite right too. As for the woman she seemed surprisingly normal, I was expecting a creature like that one who hid her daughter claiming she was missing. Depends entirely on where she was asleep. The police have to have grounds to demand a breath test - if she was asleep in the car parked up off the road then they have no grounds unless there was for example an open contianer as well, or a strong smell of alcohol. A prisoner gets hospitalised and it takes a nark to determine why? Something wrong with that scenario. Also, the incident happened over two years ago, and the officer was not suspended (on full pay) until he was convicted... and he is presumably still on full pay since the disciplinary hearing is still pending. Imagine if she ran over your best friend or paralysed you for life. Not that the cops behaviour is justified but let's get the balance right. Courts are there to deal with criminals if indeed they are guilty.Not rambo coppers that think they are a law to themselfs.I hope hes filled up collecting the soap every night of his probably protected stay!
