He should have known that other cases have been allowed to proceed; merely stating that the child was only four was never going to be grounds for having the lawsuit dismissed. I find that rather odd, but what I find considerably more odd is that the child's lawyer didn't know that, and simply assumed that "but she's four!" would see the case thrown out.
