Ebay advice needed

just got a reply from paypal,

 

dear xxx xxx

Thank you for contacting PayPal regarding case ID: PP-xxx-xxx-xxx

 

I understand that you have been informed that we cannot investigate the

dispute you filed.

 

The complaint you filed was opened on 01/30/2011 which is after our 45

day deadline and as such, regrettably, we cannot look into this claim.

 

It is necessary for us to cap the timeframe for opening a buyer

complaint. We have found that in most cases 45 days is a sufficient

timeframe for a buyer to notify PayPal that they have not received their

item, or that there is a problem with the item that they have received.

 

Additionally we are required to specify a set timeframe in our legal

agreements. This lets sellers know that they should keep their postal

information and other relevant transaction details for this period. It

also reassures buyers that should something happen with their purchase

within a 45 day period, they can open a complaint with PayPal.

 

PayPal’s Buyer Protection offers an additional layer of security,

however this does not affect your consumer rights and we advise that you

contact the Citizens Advice Bureau or Trading Standards for further

information.:(

We require eBay sellers to comply with our resolution process. eBay encourages sellers to resolve the problem with buyers. However, if the seller does not do this within the time periods set out above, eBay retains full discretion to make a final decision, and sellers and buyers hereby permit eBay to make a final decision, in favour of the buyer or the seller based on criteria eBay deems appropriate, in our sole discretion, on any case that a buyer opens with eBay under the eBay Buyer Protection Policy. If eBay makes a final decision in favour of the buyer or seller, each party must comply with eBay’s decision. For seller unresolved cases, the seller will not receive a refund on their eBay or PayPal fees associated with the transaction.

 

eBay may, but is under no obligation to, pay the buyer part or all of the item price (including postage and packaging) or give them an eBay voucher, even if we find in favour of the seller. In this situation, the seller will not be required to compensate eBay.

this means that if you haven't received payment in the 45 days the seller is still accountable.ignore paypal decision and contact ebay by phone.

ebay and paypal suck,they are the same company combined..you will not get anywhere with paypal they are worse than useless.take a tip from me buy off amazon uk next time they got a much better set up and payment processing.xx

 

yep a hard lesson iv learned costing me a lot of money,think im keeping away from buying :(

just chalk this one up to experience..seriously tho ebay are crap..fees are too high..they seem to have cornered the market so they make the rules..its crazy really tbh..google checkout wanted to be added to their payment options but ebay wasnt having any of it..its paypal or nothing with them which is very one sided..they win twice..they sting you with fees on ebay and you pay again through paypal.good luck again when you decide to buy stuff again off the internet,once bitten twice shy.:)
