April 29th 2011 - When is a Bank Holiday not a Bank Holiday?

we'll have it off BUT we have to use the day out of our normal holidays as its always been stated on the holiday sheet any future bank holidays must be "paid for" out of our holiday entitlements

 

What the holiday sheet says is irrelevant; what does your contract say? (And remember it's illegal to not have one.)

 

As dvp82 suspiciously wondered, it's the contract that is legally binding.

What we have been told is if your working that day, its going to be treated as a normal day, payed at normal rate and no extra day off at a later date, anyone rotaed not to work that day it will just be treated as a normal day off.

 

I don't know the laws regarding bank holidays, is the company i work for pulling a fast one on us.

 

AFAIK, no company is obliged to give people paid Bank Holidays.

 

If your employment contract gives you paid bank holidays and if 29th of April had already been declared to be a Bank Holiday when you entered into that employment contrtact, you might have a good argument.

 

If you were working for the company before the 29th April was declared to be a Bank Holiday, you might have difficulty in arguing that the company was in breach of contract.

 

Go and talk to an employment law specialist.

We too will be working this day, at normal rates and will be given an additional day's holiday to take when we like. The Queen's jubilee day next year will also be treated in the same way. Suits me - would rather take the day when it is convenient to me.

 

We also work Good Friday, May Day and August Bank Holiday at normal rates and get them back in between Christmas and New Year (the business just close for a week).

In law, no; the legal minimum requirement is 28 days. That is often, but does not have to be, 20 days leave plus 8 bank holidays.

 

If the contract says "plus bank holidays" then it doesn't matter when a bank holiday is declared, or when the contract was signed. Any and all bank holidays fall within that phrase. If it specifies a number of them, then any extra ones fall outside the contract.

We will be getting normal bank holiday rules for this , x hours @ plain time , plus a day added to our time off cards. So effectively double time if you work it , plus a compensatory days holiday , if you are not rostered to work on this day then you just get a day added to yout holiday entitlement.
