It's a contract between two individuals, and perhaps a ceremony to celebrate this agreement. Why do we need a 3rd party licencor involved to legitimise this otherwise private contract? Also, if the state were completely out of the business of marriage, the debate over what defines marriage would be moot, since the individuals themselves would define it.
