What I would do is find out if there is post office you can get tax from near the test centre and then when you have test certificate take it along with your proof of insurance and tax it before you drive it again

In agreement with Obelix the DVLA site does agree with driving to and from an MOT centre for a PREBOOKED mot, the MOT centre must also be prepared to vouch for you if you are stopped.

However - is your insurance valid for road use with no mot or tax?

Its still an offence to drive with no tax.

What if the car fails the MOT - it can't be moved or taken anywhere.

If you are changing a car the day after the road tax has run out and have proof that you are taking your car in part exchange then you can still be fined, it depends on the police officer. The DVLA said that the only way to be certain of avoiding being pulled over is to tax the vehicle, so depending on your vehicle could cost over £100 just to take your vehicle in for part exchange. They ought to allow people to take a vehicle in for part exchange without risk of prosecution as long as it is only the day after the tax has expired and of course that they have proof of the sale.

I'm wondering if the situation may have changed now that any car that is not taxed must be SORNed and as such should not be on the road, also regarding insurance most insurances are invalid if the car is not road legal i.e. taxed and tested, seems to be a few catch 22s involved here.

You can drive an untaxed vehicle without MOT to and from a pre-arranged MOT test, so getting it home after failing a test isn't a problem.

You can also take a non-MOT'd/untaxed car to and from a garage for work required for the MOT, as long as that work is pre-booked.

The dichotomy here is that it remains illegal to drive a car which is not roadworthy, and by definition a car that has failed an MOT and needs work to pass the test must be unroadworthy - on this matter the expression 'the law is an ass' springs to mind.

You can even drive a recently imported car without MOT, tax or even number plates to a DVLA office for initial inspection, insured only on its VIN number, but that’s another story.

The government website clearly states that you are free to take an untaxed vehicle to the MOT center as long it is pre-arranged and insured.

I was faced with this dilemma only this year and the garage who did the MOT when I made the appointment confirmed it is OK.

That is all very well but most insurance policies will stipulate that the cover only applies if the car is maintained in a roadworthy condition. So it might be arguable to drive to a test centre without an MOT certificate, but if the car fails the test you would be knowingly driving and unroadworthy vehicle if you attempted to drive home afterwards.

Unless you had the work done at the garage of course.

But on that note, how many people take their taxed cars away from the garage when its failed the MOT?

Well as the law stands a test station would be breaking the law if they allowed you to drive away in a vehicle that they considered not roadworthy.

Jeez after all that's been said.

IT'S NOT ILLEGAL! Read the website - it says in big letters it is permissible to drive a car without TAX without an MOT to a prebooked test! If the car fails an MOT you are permitted to take it via road to a place of repair be that your house or a garage.

If you think otherwise please cite an appropriate authoritative source instead of just spouting FUD and making life difficult for people.
