Police powers to sentence

Recommended Posts

Wonder why anyone would disagree with the victim deciding the punishment?

Probably those who break the law I guess would think that?

because people can be irrational.

'he robbed me, hang him!'

it's pretty obvious really isn't it?

They need to be tried and judged by impartial people with experience and given a punshment that is relative to the crime.

because sentencing needs to be impartial, fair and consistent

if you are emotionally connected to the crime you may want a harsher punishment to be issued, on the other hand you may wish to forgive and forget

so you would get situations where, for example, one person is mugged and the perpetrator sentenced to several years in a maximum security prison because the victim demands it, and another person is mugged causing the same amount of injury to the victim and the perpetrator is let off with a caution because the victim demands that

the perpetrator will still have committed a crime and deserve punishment for that but the sentencing needs to be consistently applied and the emotions of the victim can cloud that causing unfairly harsh or unduly lenient sentences to be issued
