Jailbreaking isn't Illegal in the UK

That's a simple statement really, it's not illegal to jailbreak, or root, or otherwise gain full access to a piece of hardware that you own. With the caveat that you aren't doing so in order to run pirate games.

The legal bit is

 

British law, in the "Copyright and Related Rights Regulations 2003", says it's okay to break these "technical measures" for interoperability reasons, but not for the purposes of infringing copyright.

 

I don't think there's really any question about the practice then, which means (and note I'm not questioning anything here, just making a statement) that selling such a device is not breaking the T&Cs of this site.

Presumably, this bit of the classifieds guide is applicable:

Modified or 'chipped' consoles or any other device or article which may circumvent or infringe on copyright.

A jailbroken phone potentially enables copyright infringement.

Regardless of whether jailbroken phones are legal or not the forum rules do not allow them to be sold. This is a private site with rules that you agree to abide by when you join the site and the owner has a policy on these items which is what you as users have agreed to comply with.
