That's just not true is it. Pedestrians have every right to cross the road, every accident is different and either party can be at fault.

I didn't say it was true - that's why I said 'should'. It's an opinion - my opinion is that pedestrians who stray into the road not on crossings do so at their own risk and the driver of a car they walk into the path of should not fear blame (in most cases).
