Your family member could try to attempt suicide in jail (suicide is a characteristic of borderline). Get you family member to see a Doctor for a full evaluation. The shop can choose whether they want to prosecute or not. The value of the goods, personal circumstances, plea from the accused, witness evidence, previous form, previous punishment.....all have an effect on the circumstances. As other more sensible people have stated a third strike, particuarly with previous bail conditions, could be the nail in the coffin and they may proceed to sentence.
