Rochdale nine sentenced today

So 3 out of the 9 will actually serve 5 years or more? Wow. Such tough sentences. And prisons are so harsh, aren't they? With no luxuries whatsoever?

 

No they've received the sentences as described, whether they become eligible for early release is another matter.

what does he expect to get on appeal though....nothing no sentance? hes a beast and should be locked up, more than 8 yrs IMO

 

Appealing on these grounds would be asking it to be declared a mistrial, or an unsafe conviction.

 

A mistrial means we go through it all again; an unsafe conviction means he goes free as an innocent man.

The sentences are pathetically short. There should be no early release for any criminals, what is the point of handing out sentences when they have to serve less than half that length of time?

 

The question remains Happ Hazzard, aren't you nonetheless amazed? The judge exceeded your wildest sentencing expectations!

 

I'd be amazed if they got more than 5 years. The justice system in this country is an utter joke.

The point is to save court time, but it's not usually explained very well.

 

Suppose a man goes to jail for three years, and will have to serve all three years. If he thumps someone while inside, you'd have to go through a whole new assault trial and secure a conviction, in order to keep him inside for another three years.

 

Suppose, instead, that he goes to jail for six years for the same offence, and will have to serve three years. If he thumps someone while inside, there is no trial, no jury, and no cost; the governor just rescinds his early release and keeps him inside for all six.

 

Basically, remission is an incentive for people to behave while they're in jail. Personally I think it's a good idea; but that doesn't mean I support short sentences. It means that if someone deserves to go to jail for ten years, they should be sentenced to twenty. For offences like this, even ten years might not be enough time.
