Leah-Lacie
No Rolled-up holiday pay Holiday pay should be paid for the time when you actually take your holiday. Your employer cannot include an amount for holiday pay in your hourly rate (called 'rolled-up holiday pay'). If your current contract still includes rolled-up pay, you and your employer should renegotiate it. http://www.direct.gov.uk/en/employment/employees/timeoffandholidays/dg_10034711 Hmmmm

HeadingNorth
Lots of sites reckon that 'Rolled up holiday pay' is 'unlawful' The only one that matters is Direct.gov ... if that site says it is unlawful, then it is unlawful. The next question is, what do you do about it ... take the job anyway, and then when the time comes to take a week's vacation, force them to give you the holiday pay for it? ...point out that it's illegal and ask them to rewrite the contract as a minimum-wage pay rate? ...say nothing for fear of not being offered the job? (Legally, they cannot refuse you the job for that reason alone, but within the first four weeks, they can simply say "Sorry it's not working out" and get rid of you.)
