Home owners revenge

Good luck the salesman isn't too up on his law, because along with the recent ban on clamping it's also illegal to obstruct or block in a vehicle on private land.

Still he was a tool.

There's plenty of well recommended kitchen fitters on this forum.

Some years ago, we got a quote from a moving company. The guy who came out seemed a little slimy, so we told him no thank you.

A week later, he rang the bell, said he was "just passing by", saw the SOLD sign on our lawn and wanted to know if we wanted a moving quote. I told him he'd already given us one and he pretended not to remember. Again, I told him no thank you and closed the door.

A week after that he was back with the same story. This time, I didn't even open the door. I called the moving company and complained.

Re: the kitchen salesman, some people just won't take go to hell for an answer. They need directions. :hihi:

Last Monday afternoon I had a call from my wife, she was home and in a distrest state. We had enquired regarding a new kitchen just to find out a ball park price. No request was made for a visit, but this salesman decided to call and try and make a sale and would not take no for an answer.

Just for a quick background we live down a gravel lane which is private 0.7 miles from the main road in fact we are at the bottom of a Croft at the side of the Moray Firth

So I spoke to my local neighbour who owns most of the land and by magic 3 tons of bolders and hardcore was placed on the lane, my car was up the lane so I was able to come and go.

Sadly the salesmans car was unable to exit. He was not happy and demanded the obstruction be removed or he would call the police, I said go ahead, but remember you came uninvited on private property and this is a working croft so your car stays where it is untill the land owner removes the obstruction.

He then went through the fields and caught a Taxi. The lane was cleared the next day, I rang the salesman and informed him the way was clear fo him to remove his car. He came that afternoon and recoverd his car and I said to him have you learned anything he then grunted yes.

Job sorted dont think we will see him again

I know some salespeople can be incredibly pushy and hard to get rid of, but if your wife was too upset to get him to leave and you were not about would it have not been more sensible to get the neighbour who was there to call round and escort him off the premises?

I know salesmen are a pain but how did you expect to get an accurate price quote for your kitchen without a sales visit?

Were you not also blocking lawful access to the highway?

The OP said he enquired about a ball park price (not an accurate price)

Are you simple of something.

Even if the salesman called round for a visit uninvited your wife did not have to let him in. She could have insisted he left and if he refused called the police. Unless you report him as being a trespasser - which they were not - as he was invited into your home by your wife. That instantly makes him a LAWFUL VISITOR

Therefore, what sort of right did you have to block in an innocent person's vehicle and impound it - private property or not.

You might think you are clever and satisfied but YOU could have been the ones who got into trouble.

What a completley rediculous story.

Where in the OP does it say she did let him in?

If she didn't let him in presumably he would have just left so she must have. The OPS response was childish to say the least and he will find getting new kitchen quote very difficult now as he seems tio find imprisoning people acceptable way to behave:roll::roll:

Where the OP says:

salesman decided to call and try and make a sale and would not take no for an answer.

Unless they stood there on the doorstep going through all their sales pitch and then kept refusing to take no for answer what else happened.

Either way, the fact that they were on the property long enough to "try to make a sale" and "not take no for an answer" means that his wife stood there and listened. That means for the time he was there he was a LAWFUL VISITOR.

If the OP's wife was so distressed by their impromptu visit they could have either not answered, closed the door on them or even call the police if they refused to leave the property.

Still no excuse for anyone taking the law into their own hands.
