Private Parking Charge Notices [PCN] - Megathread - ALL questions in here

Hi all, I've recieved a parking notice after parking outside the shops opposite Don valley cafe, i was there about 10 mins. The notice is fron a firm called Flashpark. I've checked on bpa website and they are not registered on there. Does this mean they have got my name and address illegally? And should i appeal or ignore. Any advice please?

 

Certainly they are not listed but be wary.

If he comes back to you and says they are not members of the AOS then a HUGE complaint to your local trading standards (Philip Glaves); to the DVLA (since they claim to be able to get numbers that way and have the KADOE logo on their website. And to the BPA Ltd. Point them to the website because if they are not members they are committing a criminal offence.

 

BUT check carefully first.

 

Then - DONT ADMIT YOU ARE THE DRIVER.

 

Otherwise standard advice applies if you are in England and Wales and it isn't a lease/hire car.

 

Try and get the landowner to cancel it.

 

1. Wait for the Notice to Keeper

2. Make a soft appeal to obtain a POPLA number.

3. Make a hard appeal

 

(On their website it says they pay commission on tickets issued!! HA!!!!!!)

 

There are a number of complaints you can make too - but let's get the ticket sorted first....

They are in fact down as Vehicle Control Solutions Ltd T/as Flashpark.

 

So they are members.

 

So the previous advice applies. I'd take a dated copy of a screenshot of their website where they say they pay commission.

Were you in either of the shops there? What did the staff say?

I think the DVLA would only apply if it was an ANPR ticket. If it was a manual ticket then they only go to DVLA after 35(?) days.

They state they got a ticket parked outside the cafe which sounds to me like they had a ticket stuck on their car. Therefore the company will not have gone to the DVLA for their details (yet!). That website does state they can't go to the DVLA until after 28 days (not 35 - my mistake!).

 

So, what I meant is there is no need to complain at this stage to the DVLA because the DVLA is not involved. The are not operating under POFA until that stage. I think that means that anyone in the world can issue tickets but they can only get driver details from DVLA (and therefore operate under POFA) if they are an AOS member. And for that reason if they are not member of AOS then it is safe not to pay - but yes to Trading Standards complaint although I think there will be little they can do because I can't see how they are breaking any Laws - unless it stated on the ticket that they would be going to DVLA etc in which case TS has a very good case. I think they would need to tell you what it actually said on the ticket and the signs.

I was parked opposite the cafe on some parking spaces just outside some shops. I did'nt recieve a ticket, but was notified by post. The date was 24 sept and i was notified by post on 28 sept. so if they cant go to dvla until after 28 days where have they got my details from? thanks for the input guys.

First of all Flashpark are members of the AOS I wrote that on an earlier post.

 

You are correct they cannot apply to the DVLA until 28 days have elapsed IF it was a ticket on the car.

 

It now appears from what the OP says it wasn't a windscreen ticket and therefore an ANPR camera did it and the Notice to Keeper which is what you should now have, has to be issued in 14 days - which it has been.

Basically as I have said - "soft appeal" to the PPC in this case Flashpark.

Then when it is rejected - "hard appeal" to POPLA.

When you have replied to the NTK let us know what they say and the dates they say it.

Yep, sounds ANPR so skip back to what you said although interesting that they got the info and posted out to you in effectively three working days.

Has the general advice changed from just ignoring all correspondence from them to using the appeals process now?

 

It most certainly has. The reason is that companies like Parking Eye are issuing thousands of Small Claim Courts claims.

 

They are still easily beaten, but ignore is no longer an option. (IMHO)
