Make sure you have all the documents you have received along with the dates you have received them.

Can I just add that those who say "ignore" is the best option and they never take anyone to court - care to admit you are wrong yet?

well it true i got a letter for court summons at Northampton cc through parkingeye and i did same as you at 1st through them all in bin ,problem now is i have now details through throwing them away.

i have appealed to the court and parkingeye and awaiting their response.

this is from dec 2012

From what I can see this is a fairly new tactic...up until maybe June or July this year, it was clear that all the parking companies were just issuing a string of generic (but scary looking) letters and once you got to the end of the letter chain they simply just went away. This was certainly the case with my invoice from VCS.

 

Maybe Parking Eye have discovered a loophole that the other cowboys don't know about yet...and even though there are now a bunch of official court papers flying about, it will be interesting to see what the actual outcome of this whole process will be.

 

If the fact remains that the company can still only take you to court to reclaim lost earnings caused by your inconsiderate parking then it's not going to make them very rich.

If there is a 59 day gap at any time between your response and them replying their case is then "out of time"......I've done it.....it makes them squeal like a pig but there's nothing they can do!

No, there are others - though Parking Eye are issuing them in bulk.

 

"Ignore" was the standard advice because until October 2012 the law said they had to chase the driver. Now they can chase the Registered Keeper whose name is obtained for £2.50 from the DVLA.

 

I reckon once faced with a genuine court claim people would capitulate. They reckon that too and they are probably correct.

 

There are ways to attack that and it is possible to win - but it does require a certain amount of self-confidence not to say expertise.

 

Much easier to go down a tried and tested route of appealing to POPLA where each appeal costs the Private Parking Co. £27.00+VAT and their trade association British Parking Association Ltd. around £120.00 which comes back to them in increased fees. Done properly, an appeal to POPLA will ALWAYS win if done correctly.

 

To me that seems much better advice than "ignore" or possibly "ignore and get a Small Claims Court Letter".

 

But people will still advise "ignore" and of course if that is what they truly believe who am I to argue?

got my reply back from parking eye stating they are carrying on with procedure to take me to court.

anybody know who is owner /shop that owns the land at bradfield road ,Hillsborough so i can appeal against them ?

Me too. In fact ive ignored loads of these scam invoices from various cowboys including Excel , VCS , parking eye ,and ive never once been taken to court. Sounds like the parking scammers are trying it on with more people hoping the threat of court action will scare people into paying up . Some will be scared and pay ,some will hold their nerve and tell the scammers to sod off. As i say , ive given the parking cowboys plenty of chances to take me to court ,but they never have.
