Danny Nightingale released on appeal

An SAS soldier detained for 18 months for illegally possessing a pistol and ammunition has been released by the Court of Appeal.

Sgt Danny Nightingale, 37, from Crewe, admitted possessing the 9mm Glock pistol and 338 rounds of ammunition at a court martial earlier this month.

Judges at the Court of Appeal cut Nightingale's sentence to 12 months and suspended it.

His wife Sally, 38, cried when the verdict was delivered.

Nightingale thanked her and his supporters for their "trust and support" after walking from the central London court.

The soldier's family and friends had argued he only pleaded guilty at the court martial after being warned he could face up to five years' detention if found guilty in a trial.

The soldier had said he was given the gun as a present in Iraq.

Lawyers for Nightingale said he did not pack the weapon and, because of a brain injury, forgot he had it.

Lord Chief Justice Lord Judge, Mr Justice Fulford and Mr Justice Bean heard the legal argument at a hearing in the Court Martial Appeal Court.

 

 

It seems common sense has prevailed.

Found guilty again.

 

Quite right too. A violent man with known mental problems should never have been allowed to keep guns at home. Who knows if it could have led to another Hungerford or Dunblane.

 

No doubt this will provoke howls of rage from the pro-military, every-soldier-is-a-hero mob, but it's the right decision.
