Does your car boot need to shut properly to pass an MOT?

Need to take my brothers car for an MOT and the car boot won't shut properly, it looks like its shut but that little latch thing won't clip over, to make it securely closed I've attached some bungee ropes.

 

After looking on the MOT Checklist it is a bit ambigious as you do need to access the boot for spare and doors must securely lock.

 

So should I fix it or do you know of any MOT centres which aren't over zealous?

 

I found a friendly garage who helped me pass my car last time.

All i had to do was bodge the brakes a bit, take it to him and it was passed.

Got them sorted now like, but at the time i was utterly skint.
