Happ Hazzard
Anti-social behaviour is anti-social behaviour, whether or not the miscreant has mental health problems is irrelevent, surely? The neighbours aren't going to have their lives made less of a misery because they know that the culprit isn't right in the head.

The neighbours aren't going to have their lives made less of a misery because they know that the culprit isn't right in the head. It's very relevant because it affects the way that the authorities respond. If you breach the terms of an ASBO you can go to prison; it is senseless to send someone to prison because they are struggling to regulate their behaviour due to a mental health problem. What those people need is help with their mental health, not locking up. I'm not advocating doing nothing about people with mental health problems who behave in ways that others find anti-social, and neither does the law. The point is to make the right intervention that benefits everyone. If you apply ASBOs willy-nilly you fail to intervene properly.
