Urgent help needed re Bailiffs

They have NO RIGHT of forcible entry regardless of whose name the property is in.

 

Can people please remember this.

 

Are these people court appointed bailiffs or the private scum?

Never heard of Marstons which is the reason i ask.

Marstons are private debt recovery agents.

 

They send lots of quasi-legal threatening letters but most people I know just bin then and ignore the clowns.

 

Court appointed bailiffs and the police are the only people you need to worry about. :hihi:

The fine for travelling in a bus lane is £60 this is reduced to £30 only if paid within 14 days.

 

If your partner has paid the £30 then they should contact the council with the details.

 

If they didn't pay the fine after 28 days, the fine increases to £90.

 

At this point a 'Notice to Owner' letter should have been issued to your partner.

 

If payment still hasn't been received by the council, a Charge Certificate should have been issued.

 

If payment still hasn't been received then the case will normally be registered at the Traffic Enforcement Centre (Northampton County Court).

 

If payment still hasn't been received then an Order For Recovery will be issued.

 

If the payment still remains unpaid after this then Certificated Bailiffs are appointed to collect the debt.

 

The appointed Bailiffs can add their fees to the debt.

 

If your partner has paid the fine they should produce the evidence to the bailiffs. This will stop the problem you are having.

 

If they haven't paid the fine where have all the notices been going?

Whatever you do , DONT let these people in your house, tell them to sling their hook. They have NO power of entry and if they attempt to enter your property call the police . Debt collectors are the lowest of the low.

 

And was it until charges are over £5000 and they lose the car and horse, putting your head in sand is not right way to deal with problems

So giving into bullies that threaten and extort sums of money far beyond reasonable.

 

£200 a day in fees is ridiculous and the company should lose it's licence if it's true.

You'd be better off spending your time sorting this out with the council than trying to prove things to anonymous people on the internet. :hihi:

 

If your partner has been ignoring letters, then it looks as if he'll have to pay some of the costs involved unless he can prove that he didn't receive them. If he genuinely thought he had paid it, then as soon as he got the first reminder he should have contacted the council and either paid the £90 or challenged it.

 

As can seen from bs4124's copy and paste from the council website, this will have gone through a number of stages before it ever got to the bailiffs' letters.

 

1. Notice of Fine

 

2. Notice to Owner

 

3. Notification that a Charge Certificate has been issued.

 

4. Reminder that a Charge Certificate has been issued.

 

5. Warning of court proceedings if fine remains unpaid.

 

6. Notification of Court Date at the Traffic Enforcement Centre

 

7. Notification of outcome of TEC hearing.

 

8. Notification that an Order for Recovery will be made if fine (now plus costs) remains unpaid.

 

9. Order of Recovery made.

 

10. Notification that fine and costs will be put in the hands of a debt recovery company if it remains unpaid.

 

And all this is BEFORE Marstons send their first letter to you.

 

Are you seriously telling us that your partner received NONE of the above letters? :confused:

I have spoken to Sheffield city council who say that as far as she knows it has not gone to court and has just been passed straight to a debt collection agancy called Marstons

 

If they are not court appointed bailiffs, they have no rights to force entry to your property. Keep the doors closed and your windows locked until this blows over. If you answer the door to them, refuse them entry if they try to force past you, that is a crime. If you want to speak to them, do so outside and lock the door behind you.

How much do you think it cost to run a van and 2 staff to visit someone who refuse to pay a simple fine in the first place everyday, they might be from London for all you know

 

Clearly the guy has not told people everything, it takes many letters from council before bailiff are sent, even then bailiff with have sent a few letters to warn you to pay fine before they come knocking,

So you want the guy to bury head in sand even longer until it spirals into 10,000+ and ask every time are you bailiff before opening door? Is that the way you want to live.

You've missed the point-

Penistone is simply passing on some facts about bailiffs i.e. DO NOT let them into your house- if you do, they can enter any time in the future to seize goods, whereas, if you don't, they have no right of access.

 

It's good advice. Also worth mentioning to be wary of tricks such as them asking to use the toilet- if you let them, then they have future access.

 

None of that means the victim can't go on to sort out the debt- just don't let the bailiffs in in the meantime.
