thai Posted December 18, 2013 Share Posted December 18, 2013 In a nutshell my husband has not been paid for the last 2 weeks, all the workers have been told to expect redundancy, The company cannot pay any redundancy.My hubby is 64 in march and work since he left school. 15 years in this employ. I do not work due to disability.Basically we dont know what our next move should be. As neither of us has ever signed on or claimed benefits before. Any help appreciated. You may also be able to get the unpaid wages according to that site; What you can get The money comes from the government’s National Insurance Fund. It’s not guaranteed that you’ll get everything your employer owes to you but you can claim for: redundancy wages - up to 8 weeks’ worth holiday pay - up to 6 weeks’ worth statutory notice pay - 1 week after 1 month’s service, going up to 1 week per year of service (up to a maximum of 12 weeks) unpaid pension contributions (your pensions administrator does this for you) basic award for unfair dismissal Link to comment Share on other sites More sharing options...

Cyclone Posted December 18, 2013 Share Posted December 18, 2013 You could probably also phone the job centre, they should be able to give you some advice about what you would do first if he is made redundant. It also appears from a quick google that being made redundant when you are over close to retirement age means you can take early retirement, but I don't know what the practical implications of that are. francypants Posted December 18, 2013 Share Posted December 18, 2013 I would make an appointment to see somebody at the Citizens Advice Bureau. They are usually very helpful with information and very clued up with laws/rights etc. Also I'd do it asap as it can sometimes be a while before you can get an appointment as they are very busy. As cyclone has pointed out there is a system in place to ensure you will get the minimum statutory redundancy pay even if your employer goes insolvent. From the signs of it you make this sound inevitable and so I would proceed on that basis. Contact Redundancy Payments Helpline, which is part of the insolvency service. 0845 145 0004.They will advise you on what to do. redundancyclaims@insolvency.gsi.gov.uk Here is a written guide produced by the insolvency service. http://webarchive.nationalarchives.gov.uk/+/http://www.insolvency.gov.uk/pdfs/guidanceleafletspdf/guideforemployees.pdf You will be dealt with by the Redundancy payments office in Edinburgh. I notice the helpline is an 0845 number so you might want to ring Edinburgh instead depending on what calls if any you get free from your telecoms provider. Either way just tell them what you have told us. email erpo@insolvency.gsi.gov.uk Address Ladywell House Ladywell Road Edinburgh EH12 7UR Telephone 0131 316 5600 The claim form used to be an RP1 but Edinburgh or the helpline can send you the latest version. You will get to talk to someone and feel you are a bit more in control. 2. They can send you the forms now even though it hasnt happened yet. Oh and it will also be the same process for his colleagues and some of them might be his friends, so your husband can be the one in the know.
