Car accident query

they are clearly trying it on but it will work as an ambulance came and took them on a stretcher.the person had just had spinal surgery therefore I am sure they will be bale to make a claim.

 

The hit to the car was at 1 -3 mile per hour does that make a difference?

Any one can make a claim. Whether they are successful or not is another matter. Just report the damn thing to your insurers and let them sort it.

If they already had a pre-existing condition them I'm not sure how compensation would work out for adversely affecting it, also if a 1-3mph shunt necessitates them being carried off in a stretcher were they even fit to drive (assuming they were the driver)?

Well tell this 'someone else' to get the incident reported to their insurers ASAP. It sounds like the third party is itching for so compo and delaying reporting the incident could affect their cover.
