Question is what happens if you dont pay Since its private Thanks Firstly its NOT a fine , its a speculative invoice . You need to contact KIRKBYLAD on here , his company specialises in dealing with the Vermin who send out these invoices.
phawley
What happened to the test case last month that was supposed to sort out this once and for all it was even on the national news but I've never heard the outcome?
xdbx
Its still awaiting the judges ruling according to MSE http://www.moneysavingexpert.com/news/reclaim/2015/02/legality-of-private-parking-fines-to-be-tested-in-court-today
alchresearch
Its a legal minefield. It would be interesting to see if a ruling is made against inflated charges for simple admin work, and if that would eventually transfer to council parking. For example, if you overstay at a council car park, the fee is £50, or £25 if paid promptly. Is this also an accurate figure for admin work? And what makes up the extra £25 the council charge if its not paid quickly? In an age of automated systems do they really employ a human to do the work? Going back to Beavis's test case, his main argument is that the revenue from the parking space is zero. But what he doesn't mention is that his car being there may have prevented another car from parking (and spending) and that driver may have taken their custom elsewhere. jamesogt
Hi All so parked my car in a farmfood car park in Hillsborough and got a £85 fine today was 12 min late... have to pay within 28 days. Question is what happens if you dont pay Since its private Thanks DONT PAY! Challenge, then go to POPLA for a ruling. Costs them £28 and you will 90% win. As mentioned KirkbyLad has all the pro formas or send a letter similar to this when it goes to POPLA. _____________________________________________ The Manager Central Payment Office VCS PO Box 4777 Sheffield S9 9DJ Dear Sir or Madam, Ticket number: vc0232977 4 Vehicle registration number: RO59NPG You issued me with a parking ticket on 18/7/13 but I believe it was unfairly issued and I will not be paying your demand for payment for the following reasons. • The fee is disproportionate According to the Unfair Consumer Contract Regulations, parking charges on private land must not exceed the cost to the landowner during the period the motorist is parked there. In my case, the £100 charge you are asking for far exceeds the cost to the landowner of 1.36p per day at a cost for a £5 a year charge for a permit. The nearest public car park is at Grosvenor Casino, its daily fee is £3.50. If you choose to pursue me please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me until you answer the specific points raised in my letter. I may also add I have no intention of paying your parking invoice and any further decision you make will be referred the Parking Ombudsmen. Should you wish to decline my appeal then please supply me with a POPLA code for reference. Yours faithfully, _____________________________________________ POPLA Response The Operator states that they have incurred several costs including the costs of the issue of the parking charge. However these costs were not incurred as a direct result of the alleged breach, but would have been incurred regardless of whether the Appellant breached the terms and conditions of the parking site. I am therefore not satisfied that the Operator has proved that the amount for the parking charge notice is a genuine pre-estimate of loss. _______________________________________________ I Won. ravenesque
I am absolutely livid at getting a parking charge notice this morning whilst in Home bargains, flora St. I was in for literally 10 minutes, came out to find I was being written a ticket! I questioned why and was told - Edison ( the company) are fed up with the parking here! She told me I have parked in an unmarked bay - as had @ 10 others, yet only 6 of us had tickets! All of the marked bays were full, so I parked on the right hand side before the ramp to the fitness club - I was under the impression we could park here. The fine is an extortionate £100!!!!!! Should I contact the company to refuse to pay or ignore the fine? In two minds what to do. Others in the same situation were as aghast as I am:rant:
Bludragonfly
It depends who gave you the ticket If it is a private enforcement company take a look at the advice on http://www.pepipoo.com If it is the Council and a legally enforceable ticket you can appeal to the Council's parking services I've looked at Flora Street on Google Maps and there is a sign saying the road is a Clearway so no stopping but I can't see the ramp/bays you refer to so I don't know whether it is the Council or a private company but your 'ticket' should tell you
ravenesque
It was a private company - vehicle control services - It was not actually on Flora st that is where the small shopping centre is, it was in the car parking area for the shops. I returned to take photo evidence and more had been ticketed
