Does he have a contract from when he was with them as it should be in there ? If he has and he signed it then he hasn't a leg to stand on sadly. Did he get a P45 when he left? If not then he wasn't on PAYE so not an employee. Has he got a P60 for the tax year in question he can compare to pay slips?
