I might have missed it. the moment he tunes in then that would be receiving a live broadcast so of course he would be guilty. The man cant verify because he didnt check. I was responding to someone else's query about whether you need a licence to just own a TV - you don't. It doesn't matter if the stream is live, nearly live or whatever. What matters is that it is broadcast. The offence is to install and or use equipment to receive a broadcast signal. Something like 4oD or watching the headlines clips on the BBC News page is not a broadcast - it's an "on demand" service. However if you watched the rolling headlines from the BBC webpage that trail the TV signal by a few scant sections, then that is a broadcast and you need a licence for it. This has (I believe) two implications to you; 1) They do not need to prove your guilt "beyond reasonable doubt" but "by weight of evidence". I would say that the signed statement would be enough, obviously dependent on what you said at the time. 2) I don't think it will show up on the DBS check as it is a civil, not a criminal, matter. What are the dates that they say you are in arrears? Nope you are wrong. It is a criminal matter at the moment, so the rest is wrong as well. You are mistaking the TV Catchup website, which only broadcasts live streams and requires a licence to watch, with the generic term "catch up TV", which refers to on demand services, and does not require a licence to view.
