Obviously from a moral standpoint, how one can argue against a law and yet find the actual incident to be inappropriate. Not all simians have any laws if we want to follow that line of discussion. If he is behaving in a hostile or pervy way towards (showing too much interest in) your kids, then, you can take appropriate action. If he's just going about his business, not interested in you or your kids (as I expect would be the case), they you would be entirely in the wrong to assault him.
