Noise complaint about my 125cc scooter.

I notice that the comment about the after market exhaust only comes out at this point. If the alternative exhaust increases the noise made by your bike even by a few decibels then I'm afraid you are likely to be left with no leg to stand on if this complaint is taken further.

 

Many after market exhausts change the tone of the engine sufficiently that your neighbour would be able to pick out your bike from others no matter what time of day you left or returned, which provides an easy focus for them when you really could live without it being there.

 

As it stands, they can point to a 'modified' bike and that implies that whatever excess noise they allege you are making is made by your choice, rather than the basic noise of your bike.

 

It also gives you a good bargaining chip though. If you change back to the standard for your bike then if they continue to complain about it you can tell them that you changed the exhaust to make it quieter yet they still continue to complain about it.

 

You have a right to go out to work on your bike, as long as you're not sitting outside revving for 5 minutes before you leave or using a horn or whatever, and nobody can challenge you on it if you're being sensible.

Not true, it could be a louder exhaust and still road legal. i think it should have a stamp on it declaring its either road legal, or not road legal,

Odd comments about bedroom windows being open all night. Mine are open a little all year round to prevent condensation.

 

Anyway one issue I could see is you say you go over the footpath is that on a dropped kerb? If there is no dropped kerb you have no right to cross from your the front of your house onto the road. The council could insist that that you stop driving over the footpath until you install a driveway, apply for a dropped kerb and assuming you get permission pay to install one.

 

The council can insist on this whether you live in a council or private property.

 

I wonder if she knows this and has complained about that?

Stick the correct exhaust for the scooter back on it asap. Then ignore any and everyone who gets on to you. About the footpath issue, wheel your scooter onto the road, start it up and off to work you go. Same on returning, wheel it over the footpath and Bobs your uncle, Fanny's your aunt job sorted.

My dad used to get complaints from a neighbour way back in the fifties when he used to start up his BSA 500 to go to work in the morning and that had a standard exhaust.Some people just like complaining,the noise cannot be any worse than bin men early in a morning.I have probably woken loads of people up in a morning over the years with modified bikes and cars but they were always 100 percent road legal and taxed, tested and insured.
