The disqualification of Donald Trump and other legal urban legends

"The popularity of urban legends is a testament to the will to believe. The desire of people to keep Elvis alive or prove that a Sasquatch could exist furtively in our backyards shows the resilience of fables.

"Constitutional urban legends often have an even more immediate appeal and tend to arise out of the desperation of divided times. One of the most popular today is that former President Donald Trump can be barred from office, even if he is not convicted in any of the four indictments he faces, under a long-dormant clause of the 14th Amendment"........

Of course, the 14th Amendment "theory", is one currently being pushed by two ultra conservative legal scholars, and not Democrats at all. 🙄

The question of "Was January 6 an insurrection or rebellion?", was made clear in William Baude and Michael Stokes Paulsens paper:

"All three branches of the government have identified the attack on the Capitol as an insurrection"... presumably, they agree.

Let's hope Turleys claims are a bit more robust than these ones:

GOP's constitutional expert gets basic impeachment fact wrong at hearing:

Jonathan Turley Still Can't Figure Out Calendar, Constitution:

"basic Constitution reading comprehension" failure!

Jonathan Turley Has New Theory To Bust Hunter Biden And All It Requires Is Warping The Fabric Of Space-Time:

🤣

Still, will never be tested, there will not be a need.

The Republican Party hierarchy are failing their supporters as long as they nominateTrump as their candidate.

I appreciate that they are fearful of losing the support of the Trump faithful but it’s time to admit that the increased clamour for Trump is from a relatively unimportant section of the total electorate.

He lost last time out and has done little if anything to swing additional support from either the silent majority of Republicans or others.

A change now may not win them the election but it should be a start to put them in a better place in the future.

The Democrats will be happy if he does get the nomination.

He'd get a fail for that CSE.

Just like you failed to mention that Turley is a frequent Fox News contributor who apparently vanished down a right-wing rabbit hole years ago:

What Happened to Jonathan Turley, Really?

Jonathan Turley Brings Flair For Blatantly Misstating Basic Legal Concepts To The Trump Indictment

A couple of views:

From Slate :)

And somebody called:

Breaking Media
611 Broadway, Suite 907D
New York, New York 10012

(212) 334-1871

who doesn't have a WIKI reference.

Not hard to see why the poster fails to attribute tlinks to the random quotes :)

Here Jonathan Turley's WIKI CV

(And I can assure our readers that Turley is not some one who "apparently vanished down a right-wing rabbit hole years ago"  :) )

On the contrary, he is one of the most in demand law professors in the Media today.

Here's WIKI:

"Turley holds the Shapiro Chair for Public Interest Law at The George Washington University Law School, where he teaches torts, criminal procedure, and constitutional law. He is the youngest person to receive an academic chair in the school's history. He runs the Project for Older Prisoners (POP),[15][16] the Environmental Law Clinic, and the Environmental Legislation Project.[17]

Prior to joining George Washington University, he was on the faculty of Tulane University Law School.[17]

His articles on legal and policy issues have appeared in national publications; he has had articles published in The New York Times,[18] The Washington Post,[19] USA Today,[20] the Los Angeles Times,[15] and the Wall Street Journal.[21] He frequently appears in the national media as a commentator on a multitude of subjects[22][23] ranging from the 2000 U.S. presidential election controversy to the Terri Schiavo case in 2005.[24] He often is a guest on Sunday talk shows,[22] with more than two-dozen appearances on Meet the Press, ABC This Week, Face the Nation, and Fox News Sunday. He served as a contributor on Countdown with Keith Olbermann from 2003 until 2011 on MSNBC, and later on Current TV[25] in 2011 and early 2012.

Since the 1990s, he has been a legal analyst for NBC News, CBS News, the BBC and Fox News, covering stories that ranged from the Clinton impeachment to presidential elections.[26][17] He is on the board of contributors of USA Today[27] and is a columnist with The Hill.[28] He is currently a legal analyst with Fox News.[29]

I literally linked to the sources from which the quotes are taken. And I've no idea why you pasted in his Wikipedia CV; the entire point of the first one was to illustrate the downwards trajectory of an apparently once respected lawyer to the Fox News muppet and right-wing mouthpiece we have today, followed by a recent example of said muppetry.   Do try to keep up.

The Republicans always appreciate advice from the Left!

But don't wait for the fan mail to pour in just yet!  :)

I am not in a permanent state of right or left in politics

I despise the far right and far left with similar fervour and see Trump as a self serving opportunist who has harnessed support from some obnoxious factions .

The Republican Party should reclaim their traditional ground if they want to regain some credibility.

You see reds under the beds as a threat whereas I fear the rise of the far right.
