Would they be keeping within the Equality Act 2010 in doing so?

If they can justify it.

' Positive action is when an employer takes steps to help or encourage certain groups of people with different needs, or who are disadvantaged in some way, access work or training. '

Now what?

So you think a company who wanted to recruit more white people would fall within that remit? Or do you think, more likely, they'd be taken to court for illegal discrimination?

As I said they would have to justify their decision if it came to it.

Is that it?

Wow, there is no backstory, replace money with whatever you want.

The principal is the same.

Great point, they choose one of them, there's only one job.

Does that mean the one who didn't get the job is discriminated against?

And what if the boss of a black orientated workplace had to choose between a black candidate and a white candidate?

No that's not it. Given their justification, do you think it would be accepted?

I've no idea. Have a look at the Equality Act and see what you think.

You could look to see if there are any other cases that have gone to court.

I'm not sure where you're going with this.

Down the road signposted "double standards". Discrimination is discrimination. Not giving someone a job because of their skin colour or gender is discrimination.
