Its not their property. They are renting it from a landlord (in this case the taxapayers). The landlord sets the rules about what a tenant can and cannot do in their leased asset. Smoking is not accepted by everyone and that tenant may move out leaving the landlord forced to fix the damage before he can re-let to someone else. If the allegedly hard done by 'tenant' wants freedom to do what they want within bricks and mortar they can buy their own house instead.
