As I recall this is a new part of the MOT that came in last May, and as you say, if you present with a spacesaver fitted that will be a fail (Although not a dangerous fail) There is only one circumstance when you can have different tyre sizes fitted, and that is when you have one witha profile of 70 and the other with a profile of 72 - however this probably means you are fitting crossplys which is not likely to occur on modern cars. Decent tyres can be expensive and although a spare tyre doesn't have to be road legal, on a couple of occasions I have knocked the price of a replacement spare (new or good part worh) of the purchase price.
