A constitutional lawyer on one of the politics programmes the other week said that an Act of Parliament could be seen by the EU as a sufficient ‘democratic instrument’ to grant an extension without Johnson physically having to formally ask for it.

 

Nobody knows, as it’s all uncharted territory.

The PM could also just go to Brussels and ask for an extension of a year and then get turned down. Did parliament specify the length of any extension?

Unless the Lords amended it, Parliament specified an extension until January 2020

At the moment, the UK public are being excluded from a process which has been largely defined by the Conservative Party leadership election and a single individual’s promise made simply to win that election..

The EU need to tie an extension to agreement to do something very specific  - e.g. referendum or vote in parliament to pick a withdrawal option vs remain. Else we will be in the same place in 3 months time.

The EU knows that with Johnson now having a majority of -20 (-41 if those Tories sacked yesterday vote against him) a General Election is inevitable between now and January.

The bill specified the wording of the letter he must write.

Ah, I see. Its not much of a trap though is it as what happens now even after an extension is granted till 31st Jan?

Given that the last three years have been wasted obsessing over something which does not have the support of the population and is doing immense damage to our economy and reputation, it is time to consider more realistic alternatives.
