The disqualification clause of the US constitution Magilla linked to contains: Quote or given aid or comfort to the enemies thereof Difficult to argue that offering to pardon those attacking the Capitol wouldn't count as giving aid or comfort to them. [1] If you're still claiming they were ANTIFA or some other false flag attack, you might want to explain why he would offer to pardon them. Except, it's not up to the Senate Congress can decide he's disqualified under amendment 14, on a simple majority vote. The amendment requires only that Congress conclude that Trump gave aid or comfort to enemies of the Constitution." Trump has now admitted publicly that he tried to get Pence to overturn a legitimate election, and would pardon the people who stormed the capitol! Overturning the disqualification requires a two third super-majority vote in both houses... even after the midterms, very unlikely... oh dear!
