My suspicion is that if the shopkeeper can demonstrate that he has behaved reasonably, ie he has thought about the matter and has determined that there is a greater need (recognized in law) that overrides. Perhaps you could quote the statute you are relying on?

You are still failing to understand that masks are not ppe.

FFP3 mask are the only things that will stop airborne particles, doesn't matter whether its for PPE or a virus the principle is the same, the flimsy masks most people wear are to prevent water droplets and will not stop particles.

It's about reducing the viral load, not totally preventing it.

They aren’t there to stop airborne particles.

Wrong. FFP2 masks also stop particles and so will lots of other things.

 

Many FFP3 will also fail to stop particles being breathed out by the wearer.

No basic mask is going to totally prevent it but FFP3 are the current industry standard, the wearer has to have face fit training for whatever manufacturer masks are used.

 

Mask with mechanical ventilation are the best of the best but impractical in most cases.
