Fargate Redevelopment

Well  take a walk down Fargate & there is so much spray paint of markings on the pavement with various numbers in different colours every few feet, that it appears that everything that needs to be discovered, needs digging up; needs not to be not dug up; not needs to be disturbed has been identified? 

 

This lot should come in handy, should SCC ever think about parking a load of shippimg containers for whatever reason on Fargate in the future & are needing an underground power supply?

We're trying to compete globally with places like China where this sort of thing can be done virtually overnight. They really must move quicker. 

Penalty clauses aren’t enforceable in uk construction contracts.

Penalty clauses could allow undue punishment and unjust enrichment. That’s why they aren’t enforceable. 

 

you would just need a liquidated damages clause which most contracts of this nature will include.

 

I’d be surprised if there wasn’t one in place in this instance.

There’s no such thing as a “delay damages penalty clause”.

 

they are either delay damages (liquidated damages) or penalty clauses - you won’t find any penalty clauses in the NEC form because penalty clauses are not enforceable in uk law. You will however find a provision for LD’s in the NEC.

OK. There's a delay damages clause which can be added to an NEC3 contract which compensates the non breaching party rather than imposing a penalty on the breaching party. Similar outcome.

Anna said that because only the government can change the law.  Councils don't have the powers to do that.

Not a case of pointing fingers     -     especially when they are both equally useless.
